Terms of Service
theNetwork · Last updated 9 October 2026
These terms are the agreement between you and theNetwork for using Merci. Please read them. By creating an account or using the service you agree to them.
1. Who we are
Merci is run by theNetwork, a proprietorship owned by [PROPRIETOR NAME], at [REGISTERED ADDRESS]. Merci is not part of, or endorsed by, Meta Platforms.
2. The service
Merci learns about your business, builds a customer and brand profile, creates mostly static ad creatives, launches them paused in your own Meta ad account, manages them by stopping weak ads and giving more budget to strong ones within your limits, and sends you reports. We may add, change or remove features. We will tell you about changes that matter.
3. Your account
- You must be at least 18 and able to enter a binding contract, and you use the service for a business.
- You must give accurate information and keep it up to date.
- Keep your login private. You are responsible for what happens under your account. Tell us at once if you think someone else has used it.
- If you sign up for a company or other person, you confirm you have authority to bind them.
4. Connecting your Meta account
You connect your own Meta ad account. You confirm you have the right to do so and that you will follow Meta’s terms and advertising standards. You can disconnect us at any time from your Meta business settings. Doing so stops our access straight away. We can only do what the permissions you grant allow.
5. Your money and your limits
- Ad spend is paid by you directly to Meta from your own account. We do not hold your ad money.
- You set the spending limits. The limits are enforced by fixed rules in our software, not by AI. The AI can propose changes. Only you can raise a limit.
- New ads are created paused. By default, nothing goes live until you approve it. This approval step is a setting. If you turn it off, you authorise us to launch and manage ads within your limits without asking each time.
- A stop control that pauses your ads is always available and cannot be turned off.
6. Ad content and your responsibility
The AI can make mistakes. Ads are created for you, and you remain responsible for what is published in your name. You are responsible for checking that your ads, offers, claims and landing pages are true, are lawful, follow Meta’s advertising policies, and do not infringe anyone’s rights. Some categories, such as health and finance, have extra rules. Tell us before using the service for them.
7. No guarantee of results
Advertising results depend on many things we do not control. We do not promise any amount of sales, leads or return on spend. Meta decides whether to approve ads and may restrict or disable accounts. We are not responsible for Meta’s decisions.
8. Fees and taxes
Our fees are shown when you sign up or change plan. Fees are charged in advance, exclude ad spend, and do not include GST or other taxes, which we add where they apply and show on your invoice. Payments are handled by our payment provider. Unless the law requires otherwise or we say so at purchase, fees already paid are not refundable.
9. Your data and content
- You keep ownership of your business information, your brand material and the ads made for you.
- You give us permission to use them to run the service for you.
- Our Privacy Policy explains how we handle personal data.
- If you use us for email marketing, you are responsible for having each person's valid consent, for honouring unsubscribes, and for following the law, including India's Digital Personal Data Protection Act. For that data we act only on your instructions.
10. What you must not do
- Break the law or Meta's rules, or use the service for scams, misleading or prohibited ads.
- Upload data you do not have the right to use.
- Try to get around the limits, approvals or security of the service, or interfere with it.
- Copy, resell or reverse engineer the service.
11. Our property
The service, its software and design belong to us. We give you a limited, personal right to use it while your account is active. If you send us feedback we may use it without owing you anything.
12. Pausing and ending
You can stop using the service at any time and close your account. We may pause or end your access if you break these terms, if we must for legal or security reasons, or to protect your ad account from harm. We will tell you why where we can. When an account ends we handle your data as set out in the Privacy Policy.
13. Our liability
The service is provided “as is”. To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost business, or for ad spend that you authorised or that follows from your settings. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.
14. You protect us too
You will cover losses we suffer from claims by others that arise from the ads, content or data you give us or from your breaking these terms or the law.
15. Changes to these terms
We may update these terms. We will tell you before a material change applies. If you keep using the service after that, you accept the new terms. If you do not agree, you can close your account.
16. Law and disputes
These terms are governed by the laws of India. The courts at [CITY] have exclusive jurisdiction, subject to any rights you have that cannot be excluded by law. Please contact us first so we can try to resolve any problem.
